Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Screxa application or website (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, you must immediately discontinue use of the Service.

2. Eligibility

You must be at least 16 years of age to use Screxa. By creating an account, you represent and warrant that you meet this age requirement. We reserve the right to terminate accounts of users who misrepresent their age.

3. Account Registration & Security

• Each individual may register and maintain only one account.
• You are solely responsible for all activity that occurs under your account.
• You must not share your account credentials or allow others to access your account.
• Notify us immediately at support@screxa.com if you suspect unauthorised access.

4. The Screxa Ecosystem: Virtual Currency & Rewards

Screxa Coins and Points ("Virtual Currency") are virtual achievements earned through gameplay and brand interactions within the app. Virtual Currency:

• Has no monetary value unless and until explicitly redeemed through an active Screxa seasonal perk programme.
• Cannot be transferred, sold, or exchanged outside of the Screxa ecosystem.
• Is not a financial instrument, security, or asset of any kind.
• May be modified, devalued, or discontinued by Screxa at any time at our sole discretion.

Seasonal perks are processed between the 1st and 5th of each month for eligible top-ranking users. Eligibility criteria, perk types, and minimum thresholds may change between seasons without prior notice.

5. Prohibited Conduct

You agree not to:

• Create or operate more than one account
• Use VPNs, proxies, emulators, or any technique to mask your identity or location
• Use bots, scripts, macros, or any automated means to interact with the Service
• Exploit bugs, glitches, or unintended features to gain an unfair advantage
• Reverse-engineer, decompile, or attempt to extract source code from the app
• Harass, threaten, or engage in abusive conduct toward other users or staff
• Attempt to interfere with the security or integrity of the Service
• Use the Service for any unlawful purpose or in violation of applicable laws

Violations will result in immediate account suspension or permanent ban and forfeiture of all accumulated Virtual Currency and pending perks.

6. Intellectual Property

All content on Screxa (including but not limited to the name, logo, game assets, graphics, text, audio, and code) is owned by or licensed to Screxa Rewards and protected by applicable intellectual property laws.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for personal, non-commercial purposes. You acquire no ownership rights through use of the Service.

7. Advertising

The Screxa app is supported by advertising. By using the Service, you acknowledge and consent to the display of advertisements. Ad frequency, format, and content are determined by our ad network partners. See our Advertising Disclosure for full details.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

9. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, SCREXA REWARDS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE, INCLUDING LOSS OF VIRTUAL CURRENCY, PERKS, OR DATA.

In no event shall our total aggregate liability to you exceed the greater of (a) the total fees you paid to Screxa in the 12 months preceding the claim, or (b) USD $50.

10. Indemnification

You agree to indemnify, defend, and hold harmless Screxa Rewards and its affiliates from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

11. Termination

We may suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your licence to use the Service ceases and all accumulated Virtual Currency and pending perks are immediately forfeited. Sections 6, 8, 9, 10, 13, and 14 survive termination.

12. Modifications to Terms

We reserve the right to update these Terms at any time. Material changes will be communicated via in-app notification or email at least 14 days before taking effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of California.

14. Dispute Resolution

Before initiating any formal proceedings, both parties agree to attempt to resolve disputes through good-faith negotiation for at least 30 days from written notice of the dispute. If unresolved, disputes shall proceed to mediation before any court action is commenced.

15. Force Majeure

Screxa Rewards shall not be liable for any delay or failure to perform resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, war, government actions, internet service disruptions, or third-party service outages.

16. Miscellaneous

• Severability: If any provision is found unenforceable, the remainder of the Terms continues in full effect.
• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Screxa Rewards.
• No Waiver: Failure to enforce any right does not constitute a waiver of that right.
